DUI arrests involving a person under 21 are different in these ways:
- Refusal with no priors is the same 6 month suspension, but refusal with
a prior DUI related conviction within 5 years triggers a full year suspension
- Taking the breath test and registering .02 or more (instead of .08) results
in a 3-month suspension. Prior DUI related conviction within 5 years = 6
months
- If for some reason a person is injured or unable, and a medical professional
agrees that breath cannot be taken, an officer may order a blood sample.
